Nov 6, 2006 = PA UTA Day
Monday, November 6, 2006, is a red-letter day in the Commonwealth for those involved here with trust planning, creation, taxation, administration, or beneficial interests. It is "PA UTA Day" -- the date when the new Pennsylvania Uniform Trust Act takes effect.
Why the effective date was calculated to be Monday, November 6, 2006, not November 4, 2006, under the legislation, was explained in a posting "PA UTA: Counting the Days to 11/06/06 (Real Effective Date)", found here.
Enactment of the PA UTA was described, with reference links, in my posting "PA Enacts a Uniform Trust Act", found here.
Then, in September and October, 2006, the PA UTA was the subject of a highly-successful, well-attended, four-hour, statewide educational program that was co-sponsored by the Pennsylvania Bankers Association and the Pennsylvania Bar Association, as planned by the Pennsylvania Bar Institute. That program was described here ("PA Bar Institute & PA Bankers Association Co-Sponsor PA UTA Course").
The satellite broadcast session of that seminar, as reproduced onto DVD and VHS for personal playback, or for webcasting, should be available soon from PBI. Also, the PA UTA will be the subject of one session by Ted Watters, Esq., a key member of the PA UTA Drafting Subcommittee, during PBI's 13th Annual Estate Law Institute to be held on November 15 & 16, 2006, in Philadelphia.
Included in the printed materials for the PBI PA UTA seminar was an excellent article, entitled "Understanding the PA UTC", by Robert L. Freedman, Esq., another key member of the PA UTA Drafting Subcommittee. This article also appeared in the October, 2006, issue of the Pennsylvania Bar Association Quarterly.
That article originally appeared in the first, bi-annual edition (Summer, 2006) of the "UTC Notes" publication, offered by the UTC Project; and it is now available online.
November 6, 2006, will be a day that will live "in instruments". So, to celebrate PA UTA Day, you should read Bob's article here, in PDF format (19 pages).
